The mother of a 25-year-old Kaimuki man who was shot and killed by a Honolulu police officer after allegedly ramming a stolen car repeatedly into the officer's motor scooter in Waikiki in October 2000 is suing the city.
A lawsuit was filed in Circuit Court yesterday by attorney Robert Merce on behalf of Esther Barbadillo, who was identified in the court papers as the mother of Bernard Crivello. Crivello died after being shot in the head by police officer Phillip Lavarias, according to the lawsuit.
A lawsuit in the death of Bernard Crivello seeks unspecified damages.
Witnesses' accounts of the event differed, but city Prosecutor Peter Carlisle said last May that the officer would not be charged with any crime because his use of deadly force against Crivello appeared to be justified based on investigations by his office and police internal affairs reports.
The lawsuit seeks an unspecified amount of damages to be determined at trial.
