Ex-trustee wants her indictment dismissed

Citing the statute of limitations, former Bishop Estate trustee Lokelani Lindsey asked U.S. District Judge David Ezra yesterday to dismiss a bankruptcy fraud indictment against her.

Lindsey's lawyer, William Harrison, said the alleged actions that resulted in the charges against Lindsey and her sister, Marlene Lindsey, occurred in 1995 and the period covered by the statute of limitations is five years.

Lokelani Lindsey is scheduled to go on trial in Las Vegas on March 25.

Last month, Marlene Lindsey pleaded guilty to reduced charges as part of an agreement with federal prosecutors. She has agreed to testify against her sister.

The Lindsey sisters are accused of conspiring to hide more than $100,000 from court officials when Marlene Lindsey filed for bankruptcy in 1995.

Ezra is reviewing Lokelani Lindsey's request and will rule on it later.
