Waikiki suspect denied bail

Circuit Judge Virginia Crandall ordered a 39-year-old Waikiki man held without bail at least temporarily yesterday while awaiting a murder trial in connection with the Nov. 2 strangulation of Yoko Sanders, a suspected prostitute.

City Deputy Prosecutor Kevin Takata told Crandall that Donald Barry Marks should be held without bail because he is a danger to the community and a flight risk.

Takata said Marks was receiving money from a trust fund, and that if he were able to gain access to it, he might be able to come up with $100,000 to pay a bail bond company the required 10 percent to post his $1 million bail.

Marks told Crandall, however, that there was no trust fund and that if he had access to $100,000, he would have used it to post bail before it was raised to $1 million.

Crandall ordered Marks held without bail until a court-appointed attorney is chosen and can consult with him. The judge said she would then hold a hearing to determine whether the no-bail status should be made permanent.
