Hearings on DLNR rule changes today

Public hearings will be held across the state this morning on proposed rule changes aimed at helping the state Department of Land and Natural Resources better enforce regulations to protect coral and to monitor camping and commercial activities in forest reserves, parks and other state lands.

The proposals were developed by a DLNR task force of employees from several divisions, and are intended mainly to clear up gray areas and close loopholes, said Deborah Ward, DLNR information officer.

The hearings will cover proposed changes that seek greater protections for stony coral and live rocks — rocks that have marine organisms growing on them.

Under the proposed rules, it will be illegal to remove these marine products from state waters even if it's accidental. Current requirements stipulate that the taking must be intentional for it to be illegal.

The proposed change on camping would allow for better enforcement against those camping overnight without a permit, according to Linnel Nishioka, DLNR deputy director.

As it stands now, enforcement officers must be able to prove an intent to sleep overnight. The new rules would prohibit the possession of camping gear one hour after the closure of the park or after dark for areas with no closing time.

The proposed changes on commercial activities would prohibit such activities as charging a fee to lead a group of hikers without a permit. Current requirements require the state to prove that money was exchanged on state property.

The hearings will take place at 10 a.m. at:

  • Kalanimoku State building, 1151 Punchbowl St., board room 132, Honolulu;
  • Department of Health conference room, 3040 Umi St., Lihu'e, Kaua'i;
  • State Office Building conference room A, 3rd Floor, 54 S. High St., Wailuku, Maui;
  • Hilo State Office Building, Department of Accounting and General Services conference room B, 75 Aupuni St., Hilo.

Anyone unable to attend or wanting to present additional comments may send written testimony by Oct. 30 to the Department of Land and Natural Resources, 1151 Punchbowl St., Room 130, Honolulu, HI 96813.
