Charge dropped against Maui windsurfer

WAILUKU, Maui ­ A felony assault charge was dismissed yesterday against a windsurfer accused of "wave rage" against a professional kiteboarder in the waters off Kanaha Beach two years ago.

In an agreement with prosecutors, Dane Barnhard, 55, of Wailuku, agreed to voluntarily perform 25 hours of community service at beaches and be subject to monitoring for five years.

He also agreed to write a letter of apology and to pay $611 in restitution by Friday to Marcus "Flash" Austin, a part-time Maui resident who is one of the world's top kiteboarders.

Austin required nine stitches following a collision with Barnard in the water Dec. 20, 2000. The indictment against Barnhard alleged he deliberately sailed into the Austin.

Barnhard was ordered to stay away from the park in January and yesterday he agreed not to surf at the beach for one more year.
