Man files suit against officer

A Big Island man filed a lawsuit in federal court yesterday saying his civil rights were violated when a Hilo police officer shot him without cause last year.

The lawsuit, filed on behalf of Wendell Tangaro by Honolulu lawyer Eric Seitz, says Tangaro was sleeping in the backseat of a friend's car on Shipman Street in Hilo on April 17, 2002, when he was awakened by his friend at about 3 a.m. and warned that police were coming.

Tangaro, on parole at the time, was afraid that he might be arrested, the suit says. It says he jumped into the driver's seat, put the car in reverse and attempted to flee when he was shot by Hilo police officer Joseph Botelho.

Police have said Tangaro drove directly toward the officer, who shot him in self-defense.
