Judge asks to see return ticket

District Judge Russel Nagata yesterday ordered a local recording artist/songwriter accused of attempted murder to show him a return-trip airline ticket today if he plans to leave Hawai'i this weekend.

Aziel Al Toeaina, 25, who is free on $50,000 bail, asked Nagata yesterday for permission to attend his mother's one-year memorial service in San Francisco. Deputy Prosecuting Attorney Scotty Hu objected, saying Toeaina would be a flight risk.

Toeaina showed the judge a one-way ticket and was ordered to produce the return-trip ticket.

Nagata also granted a stay-away order prohibiting Toeaina from having any contact with Tupu Alualu, the former Saint Louis School and University of Hawai'i running back.

Hu said Toeaina fired two shots at Alualu's feet on Friday during a parking lot confrontation at Ala Moana Center before pointing the gun at Alualu's chest. The gun misfired.

According to a police report filed at District Court, Alualu punched Toeaina after the gun misfired, causing him to fall and drop the weapon. The two men had argued earlier at a third-floor lounge at the shopping center.

The report noted that the Ruger P95 9 mm semiautomatic pistol allegedly used by Toeaina is registered to an Army man formerly stationed at Schofield Barracks but that the gun was never reported stolen.

Toeaina's preliminary hearing is scheduled for June 5 at District Court.
