Former University of Hawai'i Rainbow Wahine volleyball standout Lily Kahumoku was served yesterday with a penal summons advising her that a domestic-abuse charge against her has been amended to misdemeanor third-degree assault.
"The elements of the case remain the same," Jim Fulton of the prosecutor's office said yesterday.
Kahumoku, 22, who originally had a court appearance scheduled for yesterday, now is scheduled to appear at District Court on April 30 on the third-degree assault charge.
The $1,000 bail she posted on the domestic-abuse charge will be returned to her, Fulton said. No bail was requested on the new charge.
Kahumoku was accused of abusing UH men's volleyball player José José Delgado at 1:25 a.m. April 9 at 1684 Ala Moana Blvd.
Delgado suffered minor injuries.
Under Hawai'i law, third-degree assault requires that a person intentionally, knowingly or recklessly caused bodily injury to another person or negligently caused bodily injury.
Kahumoku was a two-time first-team All-American at UH. She has signed a contract to play professional volleyball in Russia.
After her arrest last week, Kahumoku issued a statement through Global Sports Management saying the incident was a personal matter and had nothing to do with volleyball.
