Brother-in-law charged in hit-run death

A 23-year-old man has been charged with second-degree negligent homicide and failure to render aid in connection with the hit-and-run death of his brother-in-law Wednesday in Makaha.

Justin Jarrett, who was charged Saturday, is accused of driving the Plymouth Voyager van that struck Joshua K. Diaz, 18, who was walking on Farrington Highway near Lawai'a Street, according to police.

Diaz was left lying on the roadway and was run over by another car at 9:25 p.m.

Jarrett's bail is $25,000.

According to a police affidavit filed in court, Jarrett, who lives on a beach north of Kea'au Beach Park with his girlfriend and their three children, told police he was speeding at about 55 mph when he saw Diaz. Jarrett said he tried to stop, but his brakes didn't work and the van struck Diaz, the affidavit said.

Jarrett stopped and looked back, but panicked and drove off, the document said.

According to the affidavit, Jarrett had left the beach in the van after an argument with his girlfriend.

After Diaz was struck, Jarrett left his van parked at Kea'au Beach Park where it was found by police. Jarrett consulted with relatives and voluntarily surrendered to police at the Kapolei station Friday.

Second-degree negligent homicide involves reckless driving. Driving under the influence of alcohol or drugs is not a major factor. The charge of failure to render aid relates to leaving the scene of an accident.
