Lawyer: Kahumoku wants trial by judge

Advertiser Staff

Former University of Hawai'i volleyball All-American Lily Kahumoku is scheduled to appear in District Court Friday on a misdemeanor assault charge after she was granted a week's continuance by a state judge yesterday.

Kahumoku's lawyer, Scott Collins, said his client was on the West Coast and was not available for yesterday's court appearance in front of Judge Faye M. Koyanagi.

Collins said Kahumoku plans Friday to waive her rights to a jury trial to seek a trial by judge. She is scheduled to appear in courtroom 7C at 8:30 a.m.

Collins said his client is innocent on the third-degree assault charge. He declined to provide any details of the case. He said Kahumoku is "overwhelmed and thankful" for the community's support.

"It's been really overwhelming for her," Collins said. "A lot of people are just being real supportive. She's innocent until proven guilty."

Kahumoku, 22, is accused of abusing her boyfriend, UH men's volleyball player José José Delgado, on April 9 at an apartment on Ala Moana. Delgado suffered minor injuries.

A conviction on third-degree assault carries a maximum sentence of a year in jail and a $2,000 fine.

Kahumoku was a two-time first-team All-American, and was one of seven seniors who led the Wahine to the NCAA volleyball final four in Dallas last December.
