Big Island activist among five traffic fatalities

HILO, Hawai'i — Big Island activist Jerry Rothstein, 68, and his wife, Judith Rothstein, 67, were killed yesterday in a head-on crash on Queen Ka'ahumanu Highway.

A couple from Minnesota, whose names have not been released, also were killed in the wreck, which occurred at 6:27 p.m. about 5.5 miles south of the Waikoloa Beach Resort.

Jerry Rothstein founded Public Access Shoreline Hawaii, which instigated a legal case against a Kona development that resulted in a landmark decision by the Hawai'i Supreme Court that upheld Native Hawaiian rights to go onto private property for traditional gathering, cultural and religious purposes.

Police said Judith Rothstein was driving a 1990 Toyota four-door station wagon south on the highway when it crossed the center line and collided with the visitors' 2004 Saturn four-door sedan.

Jerry Rothstein was taken to the North Hawaii Community Hospital, where he was pronounced dead at 7:30 p.m. The other victims were taken to the Kona Community Hospital, where they were pronounced dead at 11:50 p.m.

Earlier yesterday, at 12:40 p.m., a 70-year-old motorcyclist was killed when he wiped out on Kohala Mountain Road, about three-tenths of a mile north of the seven-mile marker.

Police said Harry P. Hogan of Kailua, Kona, lost control of his southbound 2003 Harley-Davidson and ran off the road.

He was pronounced dead at 1:51 p.m. at North Hawaii Community Hospital.
