An O'ahu grand jury yesterday indicted a former 'Aiea dance instructor on a charge that he sexually assaulted a 13-year-old girl.

Daniel E. Jones, 20, was charged with one count of third-degree sexual assault. He is accused of sexually assaulting the girl when she was 12 between July 1 and Nov. 30, 2004.

Jones was arrested Friday night and released Saturday after posting $50,000 bail.

It was the second time a grand jury had indicted Jones on charges that he sexually assaulted students while teaching at the Rosalie Woodson Dance Academy in 'Aiea. In April, he was charged with first- and third-degree sexual assault and accused of assaulting three 13-year-old girls and a 14-year-old girl.

Jones pleaded not guilty to those charges and was released on a $150,000 bond. Trial has been set for Dec. 5.

In the latest case, police said the girl was sexually assaulted on two occasions.

In one incident, Jones and the girl were alone at the studio when he asked her to sit on his lap, according to a police affidavit filed in District Court. After she complied, Jones inappropriately touched her, the document said.

In the second incident, the girl was dancing with other students when Jones reached out and touched her on the buttocks, the affidavit said.

Myron Takemoto, Jones' lawyer, said the timing of the allegations made by the girl in the second indictment is "extremely suspicious." Takemoto said the accusations were not made until seven months after the incidents allegedly occurred.

"She reported this three months after the other girls," Takemoto said. "She is a person in a dance studio, they all know each other, they're all friends."
