Boy faces charges as adult in school attack

LIHU'E, Kaua'i — A boy who was 15 when he allegedly attacked a high school teacher with a machete will face attempted murder and other charges as an adult.

He is accused of threatening and swinging the machete at the teacher, and then defacing the teacher's car, slashing all four tires, smashing five windows and chopping at the body of the vehicle. The teacher, Timothy O'Rourke Jr. of Kilauea, suffered a gash to his left hand when he grabbed the machete and pushed the student out of the classroom.

Family Court waived jurisdiction over Andrew D. Sarita, 16, of Hanama'ulu, after concluding it could not provide him with the needed structure and supervision over an extended period of time, said Prosecuting Attorney Craig De Costa.

Sarita was arraigned yesterday in Lihu'e District Court and will face a preliminary hearing Monday on charges of second-degree attempted murder, burglary, terroristic threatening and criminal property damage.

Sarita had had one previous altercation with Kaua'i High School teacher O'Rourke, for which he was restricted to confinement at his home. The details of that case are in sealed Family Court files.

But on Nov. 22, 2004, Sarita, in violation of the court's home confinement order, is alleged to have appeared on the high school grounds with a machete. Police reports indicate he entered O'Rourke's classroom, blew cigarette smoke in the teacher's face and announced he was going to kill him.

The reports say the teacher was cut on the left hand as he grabbed the machete and shoved Sarita out of the classroom. O'Rourke evacuated three students and the infant of one of them out a back door before Sarita broke back in. O'Rourke and one remaining student escaped through another door.

Police said Sarita then attacked the car before leaving the campus.
