Police charge sex assault suspects

Police today charged five Kalihi boys in the alleged sexual assault of an 11-year-old girl Tuesday night at Beretania Community Park on 'A'ala Street.

One boy is 15, one is 14, two are 13 and one is 11. Police arrested four of the boys at their homes about 6:30 a.m. Saturday. The fifth suspect turned himself in about two hours later.

Each was charged today at 4:45 p.m. with two counts of first-degree sexual assault, a Class A felony; four counts of third-degree sexual assault; and two counts of kidnapping, police Lt. Ray Struss said.

The victim was allegedly attacked at Beretania Community Park about 7:45 p.m. as she was walking home from a school function. A companion of the victim was not harmed.

The boys are being held at the Alder Street detention facility. A Family Court hearing will be held there, possibly Monday, to determine if they will continue to be held or released.

The boys were charged as juveniles, but it is possible that prosecutors could seek to have Family Court waive its jurisdiction over the 15-year-old, which would allow authorities to try him as an adult. Jim Fulton of the prosecutor's office today said a person's prior record and the seriousness of the offense are factors in seeking waivers.

City Prosecutor Peter Carlisle indicated Saturday the boys who are 13 or 14 likely would be treated as alleged "law violators" in Family Court. The 11-year-old could be treated as a "person in need of supervision," Carlisle said.

Fulton said prosecutors are expected to file a petition to Family Court, possibly Monday.
