Man gets 30 years in rape of 85-year-old

A Kaimuki man was sentenced to a maximum 30-year prison term this morning for raping an 85-year-old neighbor last year and for failing to provide his address to the sex offender registry.

David Baldaino, 38, earlier this year pleaded guilty to the charges as part of a plea agreement calling for the 30-year term.

Circuit Judge Richard Perkins followed the agreement in imposing the sentence.

Baldaino guilty to burglary, kidnapping and first-degree sex assault in connection with breaking into the home of the woman at about 3 a.m. in March last year, threatening to kill her if she screamed and raping her.

Baldaino was armed with a pocket knife and cut the woman's hand, according to prosecutors.

Baldaino also pleaded guilty to not providing his address as a sex offender for a 1989 sex assault conviction on Kaua'i.

The Hawai'i Paroling Authority will later set the minimum term Baldaino must serve before he is eligible for release on parole.

City Deputy Prosecutor Lori Wada said she will recommend Baldaino serve the full 30 years. Deputy Public Defender Debra Loy, Baldaino's lawyer, said it's too early to say what she will recommend.
