Minutes sought on charter school firing

Jim Shon's firing continues to reverberate through the charter schools community — which contends he should not have been let go — and affect relations with the Board of Education.

In an opinion released this week, the Office of Information Practices has advised the Board of Education that a redacted copy of the minutes of the Sept. 7 executive session meeting in which Shon, the former executive director of the Charter School Administrative Office, was fired can be released without harming certain privacy interests of both parties.

The OIP said that those portions of the minutes can be released which reflect the motions voted on regarding Shon's retention as well as the votes cast by individual members.

The OIP advisory opinion called for release by Nov. 1, but as of yesterday afternoon the board had not complied with the opinion.

Board chairman Randall Yee said the board would take the matter up at a special meeting next week. He said the board also would need to talk to the state attorney general before deciding on any action.

Yee said he couldn't comment on the issue until then.

Open government advocate Larry Geller as well as charter school director David Rizor from the Volcano School of Arts & Science, both appealed to the OIP for a decision when initial requests for release of the minutes were turned down by the board, according to the OIP opinion.

Geller and Rizor's requests specifically asked for release before the election because of the public interest in how board members voted.

"Many people are interested in that meeting before the election, to see who voted," Geller said. "And the OIP recognized that people want to see this well before the election."

In making its ruling, the OIP also said that "information in the minutes comprising Dr. Shon's evaluation itself, including BOE's discussion and deliberations on Dr. Shon's retention, may be withheld."

The OIP has redacted those portions of the minutes that it agrees can be withheld, and provided a copy to the BOE.

The board has released little information on why Shon was fired other than to indicate he wasn't carrying out board policies. Nothing that took place in the executive session has been released, including the vote count.
