Hilo, Kaua'i firms cited for alleged waste violations

A Hilo painting contractor has been ordered to pay a $32,000 penalty for alleged violations of the state hazardous waste laws, according to state health officials, who also issued a $18,000 penalty against a Kaua'i company for alleged solid-waste violations.The State Department of Health issued a Notice of Violation and Order for alleged violations of the state hazardous waste laws against Endo Painting Inc. The state said the company generates hazardous waste thinners and paints as part of its disposal process.
Officials reported found violations at the Endo facility in 2004 and issued a warning letter and required corrective measures.
In May 2006, the state Health Department found similar violations such as unlabeled and open containers of waste paint and solvents; leaking containers some of which were also in poor condition; and open containers of waste thinner that were allowed to air dry. Businesses are not allowed to air dry hazardous waste without a permit.
Endo has 20 days to respond to the notice and penalty.
And in Kapa'a on Kaua'i, state officials filed a notice and finding of violation and order against Kulana, Kapa'a 382, LLC and Dan Diamond for solid-waste dumping and operation of an open dump. The state said the violations occurred at the Kulana Condominium on Kaua'i and imposed a penalty of $18,000.
Kulana, Kapa'a 382, LLC and Dan Diamond have requested a hearing to contest the findings and order.
Officials said Kulana, Kapa'a 382, LLC and Dan Diamond disposed of solid waste and operated an open dump at this site. A state inspection of the site on May 18, 2006, uncovered buried solid waste that included a large truck, four tires and a crushed 55-gallon drum.
In addition to the $18,000 penalty, Kulana, Kapaa 382, LLC and Dan Diamond have been ordered to cease and desist improper disposal of solid waste and/or operation of an open dump.
The state also ordered that the Kulana Condominium be assessed for buried waste and that all waste be removed and properly disposed.
