Judge orders evidence withheld in Tantalus slayings

A state judge granted a defense request Friday afternoon to throw out evidence recovered by police from the home of Adam Mau-Goffredo four days after he allegedly shot and killed three people at Tantalus lookout last year.

Circuit Judge Dexter Del Rosario ruled that the search warrant used by police was not specific enough and constituted a "general warrant," which is prohibited by the state Constitution.

Police seized boxes of materials including writings, videos, books, CDs, photographs and other personal property from Mau-Goffredo's 10th Avenue home, Mau-Goffredo's lawyer Brook Hart said.

The ruling means the prosecution cannot use the evidence as part of Mau-Goffredo's trial on first-degree murder and other charges in the killings of three people and the subsequent robbery of a nearby home the night of July 6 last year.

Mau-Goffredo, who has been diagnosed as a paranoid schizophrenic, is expected to raise the insanity defense. He remains in custody at Halawa prison.

No trial date has been set yet.
