DOH cites Maui junkyard for operation without permit

The Hawai'i State Department of Health's Solid and Hazardous Waste Branch has filed a notice and finding of violation and order against Herman's Repairs, Auto Wrecking and Towing for the operation of a junkyard without a solid waste management permit.

The violations occurred at 1550 Kaupakakua Road in Ha'iku, Maui.

On April 5, 2005, Herman's operated a junkyard without a solid waste management permit, according to DOH news release issued today.

The DOH gave Herman's a chance to comply, sending a warning letter on April 13, 2005, that required the company to stop accepting additional junk vehicles and to remove all solid waste, including junk vehicles. DOH officials also provided Herman's with the opportunity to apply for a solid waste management permit.

On July 21, 2006, Herman's submitted an incomplete solid waste management permit application. On July 31 DOH officials notified Herman's that the application was incomplete and included a detailed list of information necessary to complete the application.

On Jan. 16, Herman's was again observed operating a junkyard without a permit. The DOH imposed a penalty of $19,800 and ordered Herman's to take corrective actions to prevent further violations. Herman's may request a hearing to contest the allegations or order.
