Gary Rodrigues federal conviction upheld

The 9th U.S. Circuit Court of Appeals today affirmed the convictions of former United Public Workers state director Gary Rodrigues and his daughter, Robin Rodrigues Sabatini.

The appellate court, while not requiring new sentences for Rodrigues and Sabatini, also ordered a "limited remand" that calls for U.S. District Judge David Ezra to determine whether he would have imposed the same sentences if he had known the sentencing guidelines were advisory, rather than mandatory.

Rodrigues was convicted in 2002 on 101 felony counts including mail fraud and embezzling union money. Ezra sentenced him to five years and four months in prison in 2003, but ruled that the ex-union leader could remain free pending an appeal.

Sabatini, who was convicted of 95 criminal counts including mail fraud and money laundering, was sentenced in 2003 to a 46-month prison term. She was also allowed to remain free while the case was appealed.
