Mesa Air suit against Aloha pilot dismissed

Advertiser Staff

A federal judge in Arizona has dismissed Mesa Air Group's lawsuit against an Aloha Airlines pilot alleging trademark infringement.

U.S. District Judge James Teilborg said his court lacks jurisdiction in Mesa's dispute with Aloha pilot Michael Uslan.

In a federal court lawsuit filed in Arizona, Mesa alleged that Uslan, who used to fly for Mesa, was one of the organizers of a Web site, www.dontflygo.com, which posted alleged defamatory information Mesa and its local interisland carrier go!

Teilborg said the Web site's content was specifically aimed at Mesa's activities in Hawai'i and not in Arizona.

Company spokesman Paul Skellon had no immediate comment. Under Teilborg's order, Mesa can refile its lawsuit in Hawai'i.
