State files complaints against 3 for used-oil violations

The state Department of Health has filed complaints and orders totaling $70,000 against Beachside Roofing LLC, Yamada Painting Contracting Inc., and Kaua'i County Department of Public Works.All three are charged with violations of the state's hazardous waste and used-oil rules.
Beachside Roofing was cited $15,000 for keeping an inspector from conducting a hazardous waste compliance inspection on Sept. 11, 2006, the DOH said in a news release Tuesday.
Yamada Painting Contracting was cited for $25,000 for an April 13, 2005 violation, when DOH officials found that the company failed to check for hazardous waste in their waste oil-based paints, solvents and used oil. The company also treated paints and solvents by air drying and adding absorbent material without a permit.
Yamada Painting Contracting corrected the violations noted during the inspection and is being required to do additional corrective measures to come into compliance, the DOH said.
The County of Kaua'i, Department of Public Works faces a penalty of $30,000 for failing to deal with used oil releases on or about Sept. 25, 2005, at their Lihu'e, Kapa'a and Hanapepe transfer stations.
These three transfer stations also failed to label their used-oil containers. Kaua'i County has cleaned up the used oil releases and implemented various measures to insure compliance with state hazardous and used oil rules.
Each party has 20 days to contest its Complaint and Order, and if it does, the case will be set for hearing.
