Judge: Aloha Airlines can proceed with Mesa suit

Aloha Airlines can proceed with its lawsuit against Mesa Air Group under a ruling by a federal judge.

U.S. District Judge David Ezra Monday rejected Mesa's motion to dismiss Aloha's Jan. 9, 2007, lawsuit, which alleged that Mesa improperly used confidential information from Aloha and sought to drive Aloha out of business.

Mesa had argued that the Airline Deregulation Act pre-empts Aloha's claims but Ezra said that the federal law does not pre-empt allegations of fraud and breach of contract.
