Lyle Mitsugi Nonaka, co-owner of Mitsu-Ken Okazuya & Catering in Kalihi, is accused of three counts of first-degree sex assault, one count of third-degree sex assault and one count of first-degree promotion of child abuse.
Nonaka was charged earlier this month and was released after posting $150,000 bail. Today's indictment supersedes the preliminary hearing, which was scheduled Dec. 7 at District Court.
A no-contact order has also been issued to Nonaka pertaining to the alleged victim.
A bench warrant will be issued for Nonaka's arrest leading to an arraignment at a yet-to-be-determined date.
The charges stem from a complaint in which the boy alleges he was forced to have oral sex on different occasions with Nonaka between September and October of this year after meeting him through an Internet site.
Eric Seitz, Nonaka's attorney, said today he was not surprised by the indictment. Seitz declined further comment.
