Judge's ruling favors Stop Rail Now

Stop Rail Now's anti-rail ordinance appears headed for the November ballot.

Circuit Court Judge Karl Sakamoto this morning ordered the Honolulu City clerk to accept the group's petition asking the question be put before voters.

Stop Rail Now claims it has collected 49,041 signatures to put the issue on the November ballot. The group sued the city last week after Honolulu City Clerk Denise De Costa refused to accept the petition. The clerk argued the petition was delivered too late to make the November election.

Under today's decision, the clerk has 20 business days to verify whether the group gathered enough valid signatures to place the issue before voters.

The group plans to deliver nine boxes of signed petitions to the clerk's office at Honolulu Hale at 3:15 p.m. today.

Stop Rail Now's proposed ordinance reads: "Honolulu mass transit shall not include trains or rail."
