Fugitive sex offender indicted by Oahu grand jury

A man sentenced in December 2007 to one year in prison and five years probation for second-degree sex assault was indicted today on seven counts of sexually assaulting a girl in January 2008.

Jon Joseph Rutherford, 21, was charged today with two counts of first- and four counts of third-degree sexual assault on a girl under the age of 14 between Jan. 11 and Jan. 31, and also for failing to comply with sex-offender registration requirements.

A $250,000 warrant was issued today for Rutherford's arrest on the new charges. He is wanted on a $25,000 probation-revocation warrant issued Feb. 12.

A prosecution motion seeking a 10-year prison term for Rutherford for the second-degree sex assault which occurred Sept. 11, 2006, was denied last year. Rutherford was given credit for time served at his Dec. 3 sentencing and was essentially placed on five years probation.
