Los Angeles County prosecutors say they will not file felony charges against mega-star Kanye West, who was arrested Sept. 11 at Los Angeles International Airport on suspicion of criminal vandalism.

Kanye was captured on video facing off against a paparazzo, grabbing his photo equipment, and breaking a flash on the floor. West had been scheduled to board a flight to Honolulu. He eventually was able to travel to the Islands, where he reportedly recorded tracks for his next album.

The case has now gone to the L.A. city attorney's office, which says it will decide next week whether to file a lesser charge.

BUSTA RHYMES GETS RIGHT TO RAP

LONDON — American rapper Busta Rhymes won a court order yesterday allowing him to perform at a charity concert in Britain, despite a government attempt to keep him out of the country.

High Court Justice Nicholas Stadlen rules that Rhymes — whose real name is Trevor George Smith Jr. — can play at London's Royal Albert Hall for volunteers who earned their tickets by doing four hours of community service.

The judge said he did not want to interfere with that concert.

"What weighs in the balance is not just what effect that would have on Mr. Smith, to which I pay considerably less regard than the effect on the 4,000 volunteers who would be disappointed if he didn't perform this evening," Stadlen said.

Immigration officials stopped Rhymes on Thursday at London City Airport, citing his previous legal trouble in the United States, according to Rhymes' promoters.

In March, a New York judge sentenced Rhymes to three years of probation for assaulting his former driver and a fan.

DJ AM OUT OF GEORGIA HOSPITAL

The Joseph M. Still Burn Center in Augusta, Ga., yesterday announced that DJ AM (Adam Goldstein), who suffered second- and third-degree burns in a plane crash Sept. 19, has been sent home and is expected to recover fully.

Fellow passenger and former Blink 182 drummer Travis Barker, also badly burned, is expected to be released in two weeks. Two pilots and two other passengers died in the crash.

NO PROOF OF DUI IN LABEOUF CASE

Shia LaBeouf, arrested on suspicion of DUI after a July 27 car accident, will not be charged, says the L.A. county district attorney's office.

The office says there's insufficient evidence against him. The other driver is charged with causing the crash by running a red light.
