Man indicted on sex charges again

A professional photographer has been indicted for a second time on charges he sexually assaulted two 10-year-old students during a photo shoot in September.

Gerard Mueden, 31, was indicted by an O'ahu grand jury yesterday on two counts of third-degree sexual assault. His bail was set at $20,000.

Mueden is accused of having improper sexual contact with a boy and girl while he was at Lehua Elementary School in Pearl City Sept. 22. The Salt Lake resident was at the school to take photographs of students, prosecutors said.

At the time of the alleged incidents, Mueden was an employee of the House of Photography, which specializes in yearbook photos and student identification pictures, as well as prom and banquet shots.

Mueden turned himself in to police five days after the alleged sexual assaults.

He originally was indicted in October on identical charges. But the grand jury later told a Circuit Court judge that the panel committed an error during its proceedings and did not technically indict Mueden.

The judge dismissed the charges, but allowed prosecutors to refile them.

Third-degree sexual assault is a Class C felony and punishable by up to five years in prison.
