The man who was shot by an off-duty police officer Sunday in Makaha after allegedly attacking and threatening to kill him was identified as Kiha Silva, 25.

Silva, who has no local address, is under arrest but remains at the hospital, a police spokeswoman said. He has not been charged.

He faces a first-degree terroristic threatening charge, along with one count of unauthorized entry into a motor vehicle because the off-duty officer was in his car when he was attacked.

Police say the unprovoked attack happened about 5:10 a.m., at the Makaha 7-Eleven. Sgt. Keith Marini, a 21-year veteran assigned to the Kalihi station, had bought a cup of coffee at the 7-Eleven and got back into his unmarked police vehicle when a man allegedly started to punch him.

Police say since Marini was seated, he had trouble defending himself against the attacker's punches. Marini was about to black out and feared for his life, so he used his personal gun to fire two to three shots.

It was not disclosed how many times Silva was hit. He was taken in stable condition to an area hospital. Marini suffered severe bruising on his face and was also taken to a hospital.
