A 45-year-old Waimanalo man was charged yesterday in connection with Tuesday night's fatal shooting death of a Kailua man in his home.

Daniel Kahanaoi was charged with one count of second-degree murder, first-degree burglary, two firearms counts and violating the terms of a temporary restraining order. He remained in police custody yesterday on $1 million bail and was scheduled to make his initial court appearance this morning.

Kahanaoi is accused of shooting attorney Craig Kimsel in Kimsel's Oneawa Street home Tuesday night. Police said Kahanaoi had gone to the home to look for an acquaintance and shot Kimsel in the neck and back when Kimsel asked him to leave.

Kimsel, 47, was taken to Castle Medical Center, where he died.

In January, Kimsel filed for a temporary restraining order and accused Kahanaoi of hitting him in the face in the driveway to his home. Court records show Kimsel said Kahanaoi also left threatening voicemails, saying that he would "settle the matter."

The TRO was not served on Kahanaoi because he could not be located, according to court records.

Kimsel was shot at about 9:20 p.m. Tuesday and police issued an all-points-bulletin for the arrest of Kahanaoi, who was identified by witness Rusty Anoba, who had a relationship with the suspect. Police were told that Kahanaoi was heading to his ex-girlfriend's home in 'Ahuimanu to see his 12-year-old daughter.

Officers went to the woman's home at Maiapilo Way and arrested Kahanaoi without incident. Three men who also witnessed the shooting were driven to the home and identified Kahanaoi as the shooter, according to the affidavit.
