Bicyclist critically injured when hit by tour bus files suit

A bicyclist who was hit by a tour bus on May 2 in Haleiwa has filed a lawsuit, alleging the bus driver was negligent and swerved out of his lane into the biker, who was in the shoulder lane.

John Henderson, 34, of Waialua was about 30 minutes into a four-hour bike ride about 1:20 p.m. when he was hit while riding in the shoulder lane toward Wahiawa.
Henderson sustained critical injuries, including broken ribs, a shattered pelvis, punctured lungs and damage to his spine. He remains in critical but stable condition at The Queen’s Medical Center.
Rick Fried, Henderson’s attorney, said in a news conference today that he filed suit to determine what the driver was doing that would cause him to apparently swerve out of his lane and into the bike lane.
“You’d like to think he didn’t hit him on purpose and that he must have been inattentive,” Fried said, of the tour bus driver.

The tour bus was driven by a 52-year-old Waipahu man and there were 50 passengers on board.

The suit seeks unspecified punitive and other damages.
