Judge upholds 15 of 16 labor law violations against Pacific Beach Hotel

Advertiser Staff

An administrative law judge has upheld 15 of 16 counts of federal labor law violations against the Pacific Beach Hotel.

Judge James Kennedy ruled that, among other things, hotel management bargained in bad faith during contract negotiations, coercively polled employees about their union support, withdrew recognition of the union as the exclusive bargaining representative of the workers, discharged employees because of their union activities and threatened employees with loss of their jobs if they supported the union.
Kennedy ordered the hotel to reinstate fired union negotiating committee members with back pay, bargain in good faith with the union and rescind any unilateral change with which the union does not agree.
A spokesman for the hotel said management was studying the ruling and did not have an immediate comment.
