Mother's boyfriend indicted in Hilo girl's murder

In a crime called "especially heinous," a Hilo grand jury has indicted a Wainaku man accused of assaulting, raping and drowning his girlfriend's 5-year-old daughter.

Javieanne Win, who was a first-grader at Chiefess Kapiolani Elementary School, will be laid to rest in services today on the Big Island.

The indictment will move the case of Anthony Serges Poulin from South Hilo District Court to Hilo Circuit Court. Poulin, 30, is charged with second-degree murder, two counts of first-degree sex assault, and abuse of a family household member in the Sept. 6 drowning death of Javieanne Win. He had been scheduled to return to District Court on Oct. 13 after Judge Barbara Takase granted a motion filed by Poulin's court-appointed attorney, Stanton Oshiro, for a psychiatric evaluation of Poulin by three doctors.

"Probably what will happen, because I already spoke to Stanton, is (Oshiro will) probably file a motion to dismiss the indictment because a mental exam is pending, and then, we'll just have to argue before the Circuit Court judge," Deputy Prosecutor Kanani Laubach said Friday.

Asked if a court date had been set, Laubach said, "No. I don't believe (Poulin) has been served (with the indictment and bench warrant) yet."

Poulin is in custody in Hawaii Community Correctional Center in lieu of $1 million bail.

A call to Oshiro seeking comment was not returned in time for this story.

The indictment, filed Wednesday, asks for an extended sentence for Poulin, which would mean a life sentence with the possibility of parole. The document alleges "the murder was especially heinous, atrocious or cruel, manifesting exceptional depravity ..."

Jennifer Abiley, Win's mother, was not at home, and the first-grader was in Poulin's care. Police and paramedics responded to a 3:06 p.m. call of an unresponsive child in a filled bathtub in the family's Hilo Val Hala apartment. Win died less than an hour-and-a-half later at Hilo Medical Center.

An autopsy found that Win died from "asphyxiation due to forceful submersion."

Roughly 40 minutes before emergency personnel went to the Puueo Street apartment, police received a call about a man abusing a girl at Shipman Street and Kamehameha Avenue in downtown Hilo.

A court affidavit written by police Detective Reed Mahuna said a woman "reported witnessing Poulin grab the victim by the hair, spin her around and slam her violently into the cement side of a building face first."

The affidavit also referred to a report by a registered nurse and sexual assault forensic examiner, detailing acute injuries to the girl's body consistent with "blunt force trauma during non-consensual sexual penetration."

Another police document stated that Win suffered "injuries to her entire body including a fractured arm."

Win's funeral is today at Borthwick Hawaii Funeral Home. Visitation from 9 a.m. to noon, with services at noon. Burial is at 2 p.m. at Alae Cemetery. The family is accepting donations for her funeral and burial expenses. Contributions can be mailed to or dropped off at IEG Federal Credit Union, 375 Kekuanaoa St. in Hilo with a notation "on behalf of Javieanne Win."
