The parent of go! airline yesterday posted a $90 million bond as it appeals a federal judge's ruling that it misused confidential business information.
U.S. Bankruptcy Judge Robert Faris required Mesa Air Group to post the appeal bond after he ordered Mesa to pay $80 million to Hawaiian Airlines last month for using proprietary information to launch go! last year.
The Phoenix-based company is asking for a new trial on the grounds that Faris abused his discretion by not allowing Mesa to introduce evidence that would have helped its case.
The amount covers the judgment, $4.7 million in legal fees, $3.4 million for a year's worth of interest and $1.9 million for additional costs.
In its legal papers, Hawaiian asked for a bond of $98 million, including $10 million in interest to cover a three-year period that an appeal could take.
Shares of Mesa dropped 24 cents, or 6.7 percent, on the Nasdaq market to $3.35 yesterday. Yesterday's close was the lowest Mesa's stock has traded in more than 4 1/2 years.
