Wai'anae shooting suspect is indicted

A 30-year-old man accused of an execution-style shooting in Wai'anae was indicted yesterday on second-degree murder charges.

A grand jury indicted Patrick W. Deguair Jr., who is being held on $1 million bail, for allegedly shooting Jermaine Michael Duckworth, whose body was found March 27 at Yokohama Bay on rocks below a cliff. Court documents filed earlier this week said Duckworth, 24, suffered a gunshot wound to the back of the head and other injuries.

They also said homicide investigators were told by witnesses that Deguair restrained Duckworth at a residence March 27 before driving him to Yokohama Bay where he "shot him in the back of the head with a pistol equipped with a silencer and then pushed Jermaine off the cliff."

But Deguair's attorney, Michael Green, said he does not believe prosecutors have physical evidence linking Deguair to the killing. And he added Duckworth was "not a popular guy. There are a lot of people who had motives to hurt this guy."

Duckworth was arrested Nov. 27 at One'ula Beach Park as a suspect in a Ma'ili home invasion robbery on Kula'aupuni Street, in which six people were robbed at gunpoint of cash, jewelry and credit cards by four masked men.

Deguair was arrested last Thursday at the Pagoda Hotel on suspicion of promotion of a dangerous drug and possession of drug paraphernalia. While in custody for the drug offenses, he was questioned about the Duckworth murder and charged with the killing Saturday.

In addition to second-degree murder, Deguair is charged with kidnapping and firearms offenses in connection with the Duckworth killing. He is also charged with two drug-related offenses from his initial arrest at the Pagoda Hotel, police have said.

Deguair, who listed no local address after his arrest, is a security officer at Hale Koa Hotel.

Also named in the indictment is Aryss D.K. Kamai, who was arrested Thursday at the Pagoda along with Deguair. Kamai is not linked to the shooting in the indictment, but is charged on several drug counts.

Deguair has 38 prior arrests and four misdemeanor convictions, the prosecutor's office said yesterday. In 2004, he was acquitted of first-degree attempted murder, second-degree attempted murder and several firearms charges stemming from a 2001 incident.
