Environmental Protection Agency agents are expected to conclude their on-site illegal dumping investigation in Nanakuli tomorrow but today, federal prosecutors charged two convicted felons with firearm offenses and Honolulu police reportedly identified three stolen vehicles on the 10-acre Hakimo Road property.
EPA agents, assisted by other federal officers and state Public Safety personnel, returned for a second day to 87-1161 Hakimo Road to search for hazardous waste materials such as 55-gallon drums and discarded batteries containing chemical substances and acid, respectively, tires and anti-freeze liquids buried in five holes on the property.
Federal prosecutors today confirmed no new arrests other than the two men taken into custody yesterday while EPA officials are not commenting on what, if anything, has been found on the property, owned by Peter K. Teruya but leased to another person.
Prosecutors said companies paid money to the lessee of the property to allow them to dump waste products.
The two men charged in a criminal complaint with being felons in possession of firearms are Richard Allen "Dicky" Botelho, 62, and Dwayne Luis Dano, 43, who lived on the Hakimo Road property. Botelho has 19 prior convictions, eight of them felonies, dating back to 1964 while Dano has six convictions including three for felony armed robbery in 1993.
The complaint alleges that Botelho had six firearms and amnmunition in a van which serves as his residence. Authorities seized a Smith & Wesson model 41 .22-caliber long-rifle pistol, Browning .22-caliber long rifle, SKS 7.62mm x 39mm rifle, unknown manufacturer model VZ24 bolt-action rifle, Winchester 12-gauge single-shot shotgun, and Winchester model 74 .22-caliber long rifle.
Botelho allegedly admitted ownship of the weapons to Bureau of Alcohol, Tobacco, Firearms and Explosives agents, an affidavit supporting the criminal complaint stated.
Dano is accused of possessing a Browning Arms Co. 12-gauge shotgun, which he claims was used to shoot wild dogs on the property. Agents found a used shotgun round near the steps leading to a structure he lives.
Botelho and Dano made their initial appearances today before Magistrate Judge Barry Kurren. Both are being held without bail pending a detention hearing Monday before Kurren. Their preliminary hearings are scheduled May 29 before Magistrate Judge Leslie Kobayashi.
Police investigating suspected "chop shops" in West O'ahu reportedly identified several stolen vehicles at the site.
