An O'ahu grand jury indicted Patrick Deguair Jr. and Malufafo Vito yesterday for their alleged role in a home-invasion robbery in Wai'anae.
Deguair is in custody pending trial on a second-degree murder charge in the killing of Michael Duckworth and for armed robbery at the 'Aiea Cue, a pool hall. Vito, who has been arrested 19 times and has 10 felony convictions, is serving a 10-year sentence for first-degree burglary and promoting a dangerous drug.
The home-invasion robbery took place on Nov. 27, 2007, on Kula'aupuni Street in Wai'anae. Two men entered the home of Julie Ann Derego, dressed as Drug Enforcement Agency agents and carrying firearms.
Bail was set at $250,000 for each suspect, according to the indictment.
Deguair and Vito are charged with six counts of first-degree robbery, carrying or using a firearm in commission of a felony, kidnapping, possession of a pistol or firearm and possession of a firearm by a person indicted for certain crimes.
Deguair has been held at the O'ahu Community Correctional Center on $1 million bail since mid-April on suspicion of shooting Duckworth, whose body was found below a cliff at Keawa'ula Bay on the Wai'anae Coast on March 27, 2008. He pleaded not guilty.
Deguair also was indicted on charges of first-degree robbery and kidnapping in the ATM robbery at the 'Aiea Cue on April 3, 2008.
If convicted of the Wai'anae home-invasion robbery, Deguair and Vito could receive extended sentences because of their previous offenses, court records indicate.
